See below for some restrictions, limitations, and other legal verbiage we must provide to keep the lawyers employed!
Realtors and their agencies are regulated by the State of Pennsylvania and adhere to a strict set of rules and regulations. Per Section 35.306 of the Pa Code, you are invited to review the legal details as it pertains to this offer. If you do not have internet access, you will be provided a printed version of this page upon request.
(1) Description of the certificate or gift. The postcard is a "Bearer Certificate". This means if you are in posession of it, you may claim it as your own. The certificate does not contain the offer, but is an invitation to review the offer, which appears above. The gift being offered by participating in the promotion, is that Action Real Estate will provide up to $500 as a credit on the Settlement Sheet to the benefit of the Buyer of your home, as an incentive to buy your home.
(2) The prerequisites for recieving the certificate or gift. To receive the certificate (invitation) you must have been included on a special mailing list, directed to selected neighborhoods where we desire to increase our business presence. To participate in the program your home must have a projected sale price of at least $50,000 (calculated after any seller's assist). The gift will be awarded to the Buyer when that Buyer purchases your home using an Action Real Estate agent, and successfully closes the transaction, with an actual sale price of at least $50,000 (calculated after any seller's assist is applied).
(3) Limitation on number of certificates or gifts offered. Only one certificate may be redeemed by the Seller and only one gift may be claimed by a Buyer. All other conditions and prerequisites must be met to claim gift. The number of certificates distributed varies according to the postal carrier routes that have been selected. Since the certificate can be claimed by any recipient, there are no odds, and thus the number of invitations distributed is not practically relevant.
(4) The fair market value of each certificate or gift offered. The certificates (postcards or flyers) have no cash value, and are merely an invitation to review the offer on this web page. The gift to be awarded to the Buyer of your home has a credit value of exactly 100% of the amount the buyer paid out of pocket for the appraisal on your home, up to $500. This amount will be applied as a credit on the Settlement Sheet. In no case, will a cash payment be substituted for this credit.
(5) Odds of winning or receiving the gift, prize, certificate, etc. The odds of being able to participate in this offer are 100%, as long as you meet the various prerequisites, as mentioned elsewhere on this page.
